At the end of the auction, the award cannot be final because, in accordance with the law, the Curator will notify the administrative body of the company of the essential elements of the best offer received in order to allow the exercise of the right of first refusal.
Within ten days of this last communication, the administrative body will notify the pre-emption shareholders of the proposal, who will have the right to exercise the right of pre-emption within thirty days, under penalty of forfeiture. Once these terms have elapsed without the pre-emptive shareholders having submitted any pre-emptive offer of the same price (plus auction fees and commissions), the provisional award must be considered final. For compliance with the thirty-day deadline, the date of receipt of the communication will prevail, the shipping date remaining irrelevant and the pre-emption offer must be submitted by any means that can provide certain proof of delivery
